Terms of Sale, Payment Options and Shipping Details

By bidding at Prince Castle Auctions you agree to be bound by these Terms of Sale as well as the terms of any supplemental notices announced prior to or during the auction start.

By bidding you are entering into a legal contract, please take this seriously.

All items are sold “as-is, where-is,” with any and all faults, and without guarantees or warranties. 

Registration: In order to bid, you must register and acquire a bidder number. At registration we will require identification, such as a driver’s license, and a valid credit card number. 

Auctioneer’s Determination Final: A lot will be sold to the highest bidder as determined by the Auctioneer. It is your responsibility to make sure that the Auctioneer has recognized your bid. Neither the Auctioneer nor Prince Castle Auctions will be held liable for a missed bid. In case of a disputed bid, the Auctioneer shall determine who is the successful bidder and at his or her discretion may re-offer and resell the article in dispute. 

Condition Reports: If requested, we will provide you with a condition report. All condition reports reflect our good faith opinion but do not in any event constitute a representation or warranty about an item and are non-binding.

Reserves: Unless expressly stated by the Auctioneer prior to sale, Prince Castle Auctions does not have reserves on any items.

Withdrawal of Property: Prince Castle Auctions reserves the right to withdraw property from sale for any reason, at any time, prior to sale and with no liability whatsoever.

Title: Title to an item immediately transfers from the consignor to the highest bidder when the Auctioneer says “sold.” Should you be the highest bidder on an item, you are the purchaser of that item and you immediately become party to a binding contract with the consignor (Prince Castle Auctions acts as agent only). At this point you assume liability for your newly acquired property.

Payment: Payment is due the day of sale for in-house bidders. For absentee, phone and internet bidders, payment is required within 7 days of the date of sale. Prince Castle Auctions will email an invoice to all successful bidders within 48 hours of the end of the auction. Prince Castle Auctions accepts cash (in-house bidding only), wire transfers, all major credit cards(Please note: Prince Castle Auctions will only accept payment by credit card for invoices of $20,000 or less. Payment for invoices greater than $20,000 must be made via wire transfer). Bidders outside the U. S. will be required to pay by wire transfer. The Buyer’s Premium is part of the purchase price, as is sales tax if applicable. 

Sales Tax: We are required to charge Texas sales tax at the current rate unless you provide us with a valid resale number at registration. No sales tax is charged for purchases shipped out of state. Property picked up at Prince Castle Auctions is subject to Texas sales tax, even if you live out-of-state (unless you provide us with a valid resale number).

Buyer’s Premium: The Buyer’s Premium is 20%. 

Shipping: At the request of the buyer, Prince Castle Auctions will authorize the shipment of purchased items, which usually ship within 7 days after payment has been received. Shipment is generally made via USPS Global Express or Fed-Ex Ground. Prince Castle Auctions is in no way responsible for the acts or omissions of independent handlers, packers or shippers of purchased items or for any loss, damage or delay from the packing or shipping of any property. Buyers are required to pay for all shipping and insurance charges. Overseas duty charges are the responsibility of the successful bidder.

Returns: All sales are final. It is your responsibility to inspect an item for condition or authenticity before purchasing it. No refunds are given.

All comments and descriptions, whether verbal or written, are rendered solely as opinion, are not binding and are subject to error. 

Liability: Prince Castle Auctions acts only as agent for the consignor and is not liable for any breach or default by the consignor.
